In recent days, an article titled “Legal Risks Faced by Hospitals under a New Financial Leasing Model and the Corresponding Strategies” was co-drafted by our senior partner Chen Gang and two partners, Chen Su and Zhou Wenjie and published on the journal of Medicine and Society (Issue No.10, 2021).
This Article points out that financial leasing is one of the core financing methods for hospitals to solve their financial difficulties and optimize their financing channels. By taking a new financial leasing model as an example, this Article analyzes its "innovative" business model and related court judgments, and points out that, in the course of financial leasing business conducted by hospitals, there exist following problems, such as severe lack of awareness of legal risks, failure to pay the rent on schedule, poor management over the leased property, and failure to properly and effectively exercise statutory rights, etc., which have caused hospitals in a very disadvantageous position in case of dispute. Hospitals shall construct an effective risk prevention and control mechanism by improving their management over financial leasing and the mechanism for identifying and managing legal risks in connection therewith and by strengthening the daily management of leased property and related evidence management .
